Respect for Originality and Intellectual Property
Original Work Requirement: all submissions must be wholly original creations or must include substantial transformative elements if based on pre-existing content. Using copyrighted materials, even if modified, is not permitted unless you own the rights or have explicit permission
Protecting the Integrity of Creations: each creator’s work is their intellectual property. We require that all users respect the creative process by avoiding imitative practices that unfairly capitalize on the originality of others
Prohibited Content and Imitation Practices
Cloning and Derivative Works: a derivative work is any item that closely resembles another creator's original work in design, theme, or essential attributes. Such works are not allowed on our platform without significant originality
Examples of Prohibited Content: - Simple color changes or slight alterations in shape or size are not considered original and will be rejected - Creating items that are nearly identical in overall design, structure, or recognizable traits to another creator’s work - Mimicking another creator’s style, characters, or unique elements without substantial modification or creative input
Enforcement Actions and Penalties
Initial Violation (First Offense): the infringing item will be removed from sale, and the creator will receive a formal notice explaining the violation. They will also receive guidance on how to ensure future submissions align with our originality standards
Repeated Violations: - If the creator submits additional content that violates our policies, their account will face temporary suspension, during which all their items will be removed from sale - Continued violations will result in a permanent ban, prohibiting the creator from submitting content in the future. All their previous content will also be removed from the portal
Content Review and Dispute Resolution
Reporting and Review Process: - Creators who believe their work has been infringed upon may report the content through our designated reporting channels. Reports must include specific details about the alleged infringement. Reports may be submitted on discord or through the Faraway Support email: support@faraway.gg - Our review team will investigate reported content thoroughly, comparing it to the original work to determine if a violation has occurred. This process may include consulting with the original creator to understand the specifics of their work
Disputes and Appeals: - Creators who believe their work was unfairly flagged can submit an appeal. The appeal process includes a review by a different member of our team, ensuring a fair and impartial decision. - Final decisions on disputes will be communicated directly to the creator, along with any actions to be taken.
Additional Guidelines on Originality and Usage
Minimal Changes and Color Variations: Adjusting colors, adding minor embellishments, or resizing components does not make a work original. Such modifications are not sufficient to qualify as a new item.
Public Domain and Licensed Materials: Content incorporating public domain or license-free materials must undergo significant creative transformation. Simply repackaging such content without substantial changes is not permitted.
Acknowledgment of Influences: While it’s acceptable to draw inspiration from trends and styles, all creators are encouraged to develop their own unique approach. Direct imitation of another creator's specific style or trademark features will result in enforcement actions.
Rights and Responsibilities of Creators
Ownership of Submissions: All original work uploaded to the Creator Suite remains the intellectual property of the creator. By submitting content, creators grant us a non-exclusive right to display, promote, and distribute their content within the platform.
Community Standards: We are committed to maintaining a community that values creativity and respect. We reserve the right to amend these policies as necessary to address evolving concerns and maintain a fair and positive environment for all creators.
Policy Updates and Future Expansion
These rules may be expanded or adjusted as needed to address new challenges and ensure the ongoing integrity of our creator community. We encourage all creators to stay informed about updates to our policies and to contact our support team with any questions.
